By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).
WARNING: The products sold on this site (Refrigerants) are regulated by the U.S. Environmental Protection Agency (EPA) under the Clean Air Act.
Certification Requirement: By purchasing refrigerants from Refrigelle (including but not limited to R-410A, R-22, R-134a), you certify that you are currently certified pursuant to **Section 608 of the Clean Air Act**, or that you are purchasing the refrigerant for resale to a certified technician.
Verification: We reserve the right to request proof of certification prior to fulfilling any order. Failure to provide such proof upon request may result in order cancellation.
Legal Liability: You agree to indemnify and hold Refrigelle harmless from any liability, penalties, or fines arising from the misuse, illegal handling, or venting of refrigerants purchased from our store.
Hazmat Transport: Our products are classified as Hazardous Materials (Compressed Gas). We ship strictly via Ground Transportation in accordance with DOT (Department of Transportation) regulations.
Restrictions:** We **cannot** ship to PO Boxes, APO/FPO addresses, or locations outside the contiguous 48 United States. Any order placed with an invalid address will be canceled.
Risk of Loss: All items purchased from Refrigelle are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
Accuracy: We attempt to be as accurate as possible. However, we do not warrant that product descriptions or other content is error-free.
Modifications: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
Order Cancellation: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
Due to the hazardous nature of our products, returns are subject to strict limitations.
Unopened Items: Returns are only accepted on unopened, factory-sealed cylinders within 30 days of delivery.
Restocking Fee: A restocking fee may apply to returned items to cover Hazmat shipping and handling costs.
Damaged Goods: If a cylinder arrives damaged, you must contact us within 48 hours of delivery with photographic evidence.

In no case shall Refrigelle, our directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, strictly including but not limited to damages arising from the improper use of refrigerant gas or lack of proper HVAC equipment maintenance.
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of California
